Terms of Sale

Founder's Edition pre-orders and donations · Effective October 17, 2026

The short version

1. Who you're buying from

Elyon is made by John Roberts, doing business as Foundry, a small business in Poland, Ohio ("we," "us"). When you pre-order or donate, you are buying from or giving to us. Stripe processes the payment, but Stripe is not the seller.

Contact: John Roberts, Foundry, Poland, Ohio. Email johnroberts@foundryjr.com or call or text (380) 213-9954. We answer every email, usually within one business day (Eastern time).

2. What a pre-order is

Elyon is being built right now. When you buy a Founder's Edition, you are paying in advance for a game that is not finished. You are helping fund development, much like backing a project on Kickstarter, and you get your rewards when they're ready.

3. Founder's Edition tiers

Prices are in US dollars. Each tier includes everything in the tiers below it.

TierPriceWhat you get
Early Access$10A digital copy of Elyon for Windows PC at launch. Access to early builds when they are available. Development updates by email.
In the Credits$25Everything in Early Access, plus your name in the in-game credits.
Namer of Creation$50Everything in In the Credits, plus you suggest a name for a deity or creature in the game. Names are reviewed (see below).
Founding Patron$100Everything in Namer of Creation, plus a Founding Patron title in the credits, a digital concept art book, and backer-only feedback polls on development. Limited to 100 backers. Once 100 are sold, this tier closes.

How the game is delivered. Your copy of Elyon comes as a digital download or a product key for Windows PC, sent to the email you used at checkout. We may deliver it through a store or launcher we choose, such as Steam. You may need an account with that store, and your PC will need to meet the game's system requirements, which we'll publish before launch.

Names in the credits. We use the name you enter in "Name to credit" at checkout. Tell us if you want a different name, a nickname, or no name at all. We won't put anything offensive, hateful, or misleading in the credits, or anything that uses someone else's trademark or impersonates a real person.

Naming a deity or creature. After you buy, we'll email you to ask for your name idea. You suggest a name, and we review it. We may change it, or ask you for a different one, if it is offensive, hateful, sexual, political, copyrighted or trademarked, the name of a real person, or simply doesn't fit the world of Elyon. If we can't agree on a name, you can keep the rest of the tier or get a full refund. We decide which deity or creature gets your name and how it appears in the game. Suggesting a name does not give you any ownership of the game or the character.

Feedback polls help us hear what backers want. We read every poll, but the final decisions about the game are ours.

4. Refunds and cancellation

5. Donations

6. Early-access builds

Early builds are unfinished test versions. They are provided "as is". They may have bugs, crash, lose saved progress, or change completely. We don't promise a date for any early build. Please back up your files, and play at your own risk. You may not sell or redistribute early builds, keys, or the art book.

7. Price changes and other offers

We may change prices, add or close tiers, or run a Kickstarter or other campaign later. If we change a price, the change doesn't affect what you already paid or the rewards you were promised.

8. Using the game

Elyon and its art, story, names, and code belong to us. When you buy it, you get a personal, non-transferable license to play it, not ownership of it. The full license (an end-user license agreement) will come with the game at launch.

9. Who can buy

You must be 18 or older, or have a parent or guardian's permission and have them make the purchase.

10. Limitation of liability

As far as the law allows: our total liability to you for anything related to Elyon, your pre-order, or a donation is limited to the amount you paid us. We are not responsible for indirect or consequential losses, like lost data or lost profits. Other than the promises in these Terms, Elyon and early builds come without warranties of any kind, including any implied warranty of merchantability or fitness for a particular purpose. Some states don't allow these limits, so some of them may not apply to you. Nothing here limits your refund rights in section 4, or any rights you have that the law says cannot be waived.

11. Problems and chargebacks

If something's wrong, please email us first. We'll fix it or refund you, and that's usually faster than disputing the charge with your bank.

12. Ohio law

These Terms are governed by the laws of the State of Ohio and applicable U.S. federal law. Any dispute goes to the state or federal courts serving Mahoning County, Ohio, unless the law where you live gives you the right to bring it somewhere else.

13. Changes to these Terms

We may update these Terms. Your purchase is covered by the version in effect on the day you bought it. If we change a refund promise, the change will only ever make it better for existing backers. We'll post the effective date at the top.
